'NA Speaker Ayaz Sadiq hasn't filed any reference against Justice Khosa'

ISLAMABAD: National Assembly Speaker Ayaz Sadiq’s reference against Supreme Court’s Justice Asif Saeed Khosa has turned into a mystery with both the attorney general and the NA spokesperson denying that there was such a complaint.

The complaint against the SC judge was reportedly filed with the Supreme Judicial Council under Article 209 of the Constitution for delivering the April 20 verdict in which he questioned Sadiq’s ruling in favour of former prime minister Nawaz Sharif.

However, Attorney General for Pakistan (AGP) Ashtar Ausaf Ali said no reference against Justice Khosa had been filed.

“It appears that someone or some political party is trying to create a wedge between the legislature and the judiciary,” he said in a statement.


“You may have noticed a lot of disinformation being spread around. The idea seems to be to create despondency,” he added.

Similarly, the spokesperson for the NA on Saturday afternoon also denied that any such reference had been filed against Justice Khosa.

He claimed that it was a rumour aimed at maligning the speaker’s reputation.

The reference, a copy of which is available with The Express Tribune, read: “…unfortunately Justice Asif Saeed Khan Khosa in his judgement has attributed ‘the failure on the part of the Honourable Speaker to inquire into or investigate the matter or to refer the matter to the Election Commission of Pakistan’,” read the complaint reportedly submitted by the NA speaker.

“Such biased and unwarranted findings of the learned Judge against the Honourable Speaker also damaged the Office of the Speaker, respected worldwide…” the complainant added.


The reference further read that if Justice Khosa continued to be part of the top court, it would be ‘injurious’ to the judicial institution.

It added that Khosa’s elevation to Chief Justice of Pakistan would encourage him even more to make such unwarranted statements.

“..continuation in office of the learned Judge giving him further opportunity to write such biased, ill-founded and disputed judgements would be highly injurious to the noble image of the sublime institution of the judiciary in Pakistan. His elevation as CJP would further encourage him to flout the norms of decency, justice and propriety with impunity and in contempt of the supreme laws of the land,” the reference read.

Meanwhile, Supreme Court Bar Association General Secretary Aftab Bajwa condemned the filing of the complaint and said that lawyers were prepared to confront all ‘malicious tactics’ conjured by the government against the judges.


On April 20, Justice Khosa, who was leading the five-judge bench on the Panamagate, declared while giving out the decision of Panama Paper leaks that Nawaz “was not honest with the Supreme Court and nation”.

Khosa, while authoring the 192-page judgment, disqualified the prime minister, but his view belonged to the minority opinion and, therefore, had no binding effect on anyone until the verdict given in July later on.

The judge observed that the prime minister had deliberately suppressed relevant facts or had conveniently allowed himself to go along with a false story advanced by his children.
